Welcome to HARVZ. By accessing or using our website (www.harvz.co.za) or any of our services, you agree to be bound by these Terms of Service (“Terms”). Please read them carefully before proceeding.

1. Overview

HARVZ is a content production studio specializing in cinematic video, photography, and brand storytelling. These Terms govern your use of our website, all digital content, and any services we provide to you (collectively, the “Services”).

2. Use of Website

You agree to use this website only for lawful purposes and in a manner that does not infringe on the rights of, restrict, or inhibit anyone else’s use and enjoyment of the site.

You may not attempt to interfere with the site’s functionality or security.

3. Service Engagements

All client projects are subject to written proposals or agreements that outline scope, deliverables, timelines, and fees.

By approving a quote, signing a contract, or paying a deposit, you confirm your acceptance of the project terms and conditions specific to that engagement.

4. Payments and Deposits

• A 50% non-refundable fee is typically required to secure a project date.

• The remaining balance is due upon delivery of final content, unless otherwise agreed in writing.

• Late payments may incur a 10% late fee per 14 days overdue.

• All prices are quoted in South African Rand (ZAR) unless stated otherwise.

5. Cancellations and Postponements

If a shoot or project is cancelled by the client:

• More than 7 days before the scheduled date: deposit retained, no further charge.

• Within 7 days: up to 50% of total fee may be charged.

• Within 48 hours: full quoted fee may apply.

If postponed, HARVZ will make reasonable efforts to reschedule subject to availability.

6. Ownership and Usage Rights

Unless otherwise agreed in writing:

• HARVZ retains copyright ownership of all produced content.

• The client receives a commercial usage license for the agreed platforms and purposes.

• Content may not be resold, redistributed, or used beyond agreed terms without written permission.

• HARVZ reserves the right to use produced work for its portfolio, showreel, and promotional purposes, unless the client requests otherwise in writing.

7. Client Responsibilities

The client is responsible for:

• Poviding accurate project information and timely feedback.

• Obtaining permissions, access, and releases for locations or subjects when applicable.

• Ensuring all brand guidelines and legal requirements are communicated before production.

8. Limitation of Liability

HARVZ will take all reasonable steps to deliver professional, high-quality work.

However, HARVZ is not liable for:

• Losses resulting from circumstances beyond our control (e.g. weather, equipment failure, data corruption, etc.).

• Indirect, incidental, or consequential damages of any kind.

• Any claims exceeding the total amount paid for the specific project

9. Revisions and Deliver

Each project includes a defined number of revisions (as per proposal).

Additional changes beyond the included rounds will be billed at HARVZ’s standard editing or hourly rates.

Final deliverables are provided in digital format via secure link or drive upload.

10. Termination

HARVZ reserves the right to suspend or terminate any project or client relationship for breach of terms, non-payment, or unprofessional conduct.

11. Privacy

Your personal and business data are handled in accordance with our Privacy Policy (to be linked).

We don’t share your information with third parties except where necessary to deliver our services.

12. Updates to Terms

These Terms may be updated from time to time. Any changes will be reflected on this page with a revised date. Continued use of our website or services constitutes acceptance of the updated Terms.
